SAMPLE SHORT TERM RENTAL AGREEMENT

This Short Term Rental Agreement (the “Agreement”) is made by and between Catamaran Lane LLC (“Homeowner”) and (“Primary Renter”) as of the date last set forth on the signature page of this Agreement.  For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

1. Property. The property is located at: 129 Catamaran Lane, Moneta, VA 24121 (the “Property”). The Property is furnished and includes kitchenware, linens, furnishings, basic amounts of paper goods.

2. Rental Party: The rental party shall consist of Primary Renter and their guests. The main renter must be 25 years of age and remain on the property during the rental period.

3.  Maximum Occupancy: The maximum number of guests is limited to 8 persons. Primary Renter acknowledges and understands that (s)he is responsible for each and every guest or guardian during the short-term rental dates and is solely responsible for any property damage, accident, injury or loss sustained to any person while in residence.  Homeowner accepts no legal or financial responsibility for guests. Primary Renters and guardians assume all risk of injury or other loss resulting from a recreational activity and will hold Homeowner, Property Manager and Homeowner agents harmless hereto. Primary Renter hereby agrees to indemnify and hold Homeowner, Property Manager, agents, and officers harmless from any claim, including those of third parties, arising out of or in any way a result of the guests use of the Property or items therein.
   

4. Term of the Lease. The lease term begins at 4:00 MST p.m. on (the “Check-in Date”) and ends at 10:00 MST a.m. on (the “Checkout Date”). If Primary Renter occupies Property past the Check-Out Time, Primary Renter will be considered in violation of this Agreement and will pay Homeowner two times the daily rate plus any damages incurred due to Primary Renter’s failure to vacate.

5. Minimum Stay: This Property requires a 3-night minimum stay. Longer minimum stays may be required during the summer season, holiday or event periods. If a rental is taken for less than the minimum days for the selected time period, the guest will be charged the minimum nightly rate.

6. Rental Rules: Primary Renter agrees to abide by the Rental Rules attached as Exhibit A at all times while at the Property and shall cause all members of the rental party and anyone else Primary Renter permits on the Property to abide by the Rental Rules at all times while at the Property.

7. Access: Primary Renter shall allow Homeowner, Property Manager, agents, repairers, service personnel access to the Property for purposes of repair, maintenance, inspection or remedy of any violation of this Agreement. Homeowner shall exercise this right of access in a reasonable manner.

8. Cancellation Policy: If Primary Renter wishes to cancel his/her reservation, the deposit will be refunded as follows:

Full refund for cancellations up to 30 days before check-in. If booked fewer than 30 days before check-in, full refund for cancellations made within 48 hours of booking. After that, 50% refund up to 7 days before check-in. No refund after that. Airbnb Guests may choose to pay 10% less, in return for no refund if cancelled at any time.

Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in.

9. Damage Deposit: Damage deposit of $0 is due at the time of booking. Deposit will be held until two weeks following checkout to allow owner sufficient time to inspect premises after rental. The deposit will be refunded immediately following the two-week period. The owner would like to stress that any damages the renter encounters should be brought to the owner’s attention as promptly as possible. Owner may require the renter to purchase rental insurance.

10. Damages: By the close of the first day of rental, Primary Renter shall notify Homeowner or Property Manager of any defects or damages to the Property; otherwise, the Property, fixtures, appliances and furniture shall be considered to be in a clean, safe and good working condition and Primary Renter shall be responsible for any subsequent defects or damages discovered on Property. No refunds or fee adjustments will be made due to a serious defect in the Property’s condition unless Primary Renter makes Homeowner or Property Manager aware of the problem immediately upon discovery and the Owner/Agent, or their designated Representative(s) are unable to remediate the matter within a reasonable amount of time.

11. Non-Assignment: Primary Renter cannot assign this Agreement to any other person without the prior written consent of Homeowner, whose consent shall be withheld for any reason whatsoever. If Homeowner consents to assignment of this Agreement, Primary Renter shall still be liable for all obligations arising under the Agreement.

12. Force Majeure: Homeowner, Property Manager and Homeowner agents cannot be held responsible for the failing of any other company due to said company’s error or service interruption (i.e. electricity, water, gas, cable, wireless provider, etc.), acts of neighbors, weather, construction, road repair and maintenance or any other act of God.

13. Liability: Homeowner is not liable to Primary Renter or any guests for personal injury or damage or loss of personal property from fire, smoke, rain, flood, water leaks, hail, ice, snow, lightning, wind, explosion, theft, vandalism, or surges or interruption of utilities: except to the extent that such injury, damage or loss is caused by our gross negligence. TO THE FULLEST EXTENT ALLOWED BY LAW YOU, FOR YOURSELF AND ALL OTHER PARTIES, RELEASE US FROM ANY AND ALL CLAIMS, LOSSES, LIABILITIES AND/OR DAMAGES FOR (i) LOSS OR THEFT OF YOUR AND ANY OTHER PARTY’S PERSONAL PROPERTY, (ii) ACCIDENTS OR INJURIES TO YOU, OR ANY OTHER PARTY, IN OR ABOUT THE PROPERTY. YOU HEREBY AGREE TO DEFEND, INDEMNIFY AND HOLD US HARMLESS FROM AND AGAINST ANY AND ALL ACTIONS, CAUSES OF LOSS, CLAIMS, DEMANDS, LIABILITIES, LOSSES, DAMAGES, FINES, PENALTIES, REMEDIATION COSTS AND EXPENSES OF WHATSOEVER KIND.

14. Default and Remedies: Primary Renter is in violation of this Agreement if Primary Renter or any guest(s) violate the terms of this Agreement, the Rental Rules attached as Exhibit A, or any policies laws, codes or ordinances governing the Property. If Primary Renter or any guest(s) are in violation of this Agreement, Homeowner can, without demand or notice in addition to other remedies allowed by law sue for any and all damages incurred arising from the breach of the Agreement, terminate Primary Renter and all guests right to occupy the Property, report all violations to credit reporting agencies as permitted by law; and, seek any combination of the above named remedies or any other remedies allowable at law or in equity. The exercise of any remedy by Homeowner will not be taken to exclude or waive the right to exercise any other right or remedy which Homeowner might have under this Agreement.

15. Payment: Payment accepted via the Website.

16. Security Camera: Owner has installed wireless cameras operating in outside locations to monitor the premises 24/7 for security purposes. The camera is live activation and will record on a 24-hour basis all traffic coming and going from the house in addition to allowing the owner to monitor real time traffic as well.

17. Dock, Boat and Personal Water Crafts: Use of the owner’s boat and personal watercraft (PWC) are NOT covered by this rental agreement. Please take care in docking your boats and PWC’s and do not climb, board or move owner’s watercrafts. Any damage to the dock boat or PWC’s caused by the Primary Renter or their guests will be the sole responsibility of the Primary Renter.

The parties agree to the terms of this Short-Term Rental Agreement, as evidenced by the signatures set forth below. Homeowner

RENTAL RULES

1. Smoking is allowed outside the home and garage only and guests must use ashtrays and dispose of debris.

2. People other than those in the Primary Renter party set forth above may not stay overnight in the Property. Any other person in the Property staying as part of the rental party is the sole responsibility of Primary Renter.

3. The Property is privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the Property or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the Primary Renter or any guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the Property or others whom they invite to use the Property.

4. Primary Renter and all guests shall take good care of the Property, all appliances and furniture and will maintain the Property in a neat, clean and sanitary condition and free from pests and rodents. Primary Renter and all guests will not remove any of items from Property and will not perform any repairs or other alterations to the Property. Primary Renter and all guests shall not remove, disconnect or intentionally damage a smoke detector or remove the battery without immediately replacing it with a working one.

5. In case of malfunction of utilities or damage by fire, water, or similar cause, or injuries, accidents or property damage occurring in the Property, Primary Renter must notify Homeowners immediately. In case of malfunction of air conditioning other equipment failure, water leaks, electrical problems, carpet holes, broken glass, and any condition, which you reasonably believe poses a hazard to health or safety.

6. Parking: Parking is limited to 6 vehicle(s). 2 Vehicles can fit in the garage and 3 in the driveway and one additional near the upper level of the garage. Vehicles are to be parked in the driveway(s) and garage only. Parking on the road is not permitted. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.

7. Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We do not permit towels or linens to be taken from the premises. Beach towels are not provided. All used linens should be removed from beds at the end of the stay.

8. Dock: ● Please be cautious when on the dock as the surface can become hot and slippery. ● Please do climb, stand, untie or hang on the boatlift, boat or PWC’s. ● The items in the dock house are available for your use but should be stored in the dock house when not in use. ● Please cover dock furniture when not in use.
   ● Jumping or miss-use of hanging swings may result in personal injury or property damage. ● The cove is about 35 feet deep at the end of the dock, so no problem with using the diving board. ● The area below the rope swing is about 8 feet deep, so beware and jump out away from the shore. ● Use the rope swing at your own risk. ● Please do not use neighboring docks, floats, etc. ● Please do not touch the blue pump in the dock house as it controls our irrigation system. ● If you open a faucet on the dock or around the house, please ensure it is again closed tightly. Once water is turned on the blue pump in the dock house will also turn on to pull water from the lake. When the faucet is closed, the pump should turn off. ● Water from any outside faucet is NOT potable as it is drawn directly from the lake. ● Remove all trash from the dock after each daily use to deter animals.

9. Deck: The grill is propane powered and connected with a line to our underground tank. Turn the red knob to vertical to use the grill and return it to horizontal when done. Please clean and cover the grill after use, when cool. The center of the deck table contains a fire pit. The propane tank is located below the table. You will need to turn on the propane tank before lighting with a stick lighter. Please remember to turn off the tank when done.

10. Fireplace: The fireplace is a non-vented propane gas log fired firebox. Please do not throw any paper or other combustible materials in the fireplace. Fireplaces are turned off from the switch located to the right; the doors must remain ajar when the fireplace is in operation.

11. Weather Conditions: No refunds will be given for weather conditions or lake water levels. 
    

12. Primary Renter: The Primary Renter of this Property must be 25 year of age or older and remain on the property during the reservation. 
    

13. House Security: Primary Renter shall maintain the security of the home and its contents. Upon departure of the house, please ensure all doors are locked and the garage door is down. If the garage door is left open wildlife can enter causing damage or loss. The main renter is to ensure the garage door is kept shut at all times.
    

14. Trash and Recycling: Please bag and remove all trash and recycling upon leaving the home. All trash must be taken to the local dump site which is at the corner of Scruggs Road and Lovely Valley Road, about 2 miles from the home. Fines will be assessed if trash is left on the property. ● Franklin County recycles cans and plastic bottles only (no glass, no lids).

15. Pets:  No pets allowed unless specified above. Owner is to clean up pet waste and hair. 
    

16. Events: No parties or events are permitted at the property unless expressly agreed to in writing by the owners.
