We take your safety and security seriously and this property has special local compliance requirements of a signed rental agreement and ID verification. To make this easy for you, we use a secure and very simple, app-free platform called Happy Guest. It is not an app, and you do not have to sign up for an account - it’s a safe and secure website. It also gives you a guest portal with all the info about the home and all of my favorite local spots.

BY ACKNOWLEDGING THIS DOCUMENT, YOU CHOOSE TO WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. To: The property known as Family Tides II (Owner of Property, Releasees) AND Sun Sand Rental Management, L.L.C. (Management Company, Releasees)

I wish to swim at the pool or hot tub during the length of stay at your vacation home. By swimming in the vacation home pool and/or hot tub, I recognize and fully understand certain things, including: At no time is there a lifeguard on duty, you (the guest) are responsible for the safe operation of the pool and are responsible for all persons using the pool during your stay. My use of the pool facilities during my stay involves certain risks, including but not limited to:

1. The risk of injury resulting from possible malfunction of the pool equipment
2. The risk of injuries resulting from tripping or falling over obstacles in the pool area
3. The risk of injuries resulting from unsupervised divers and swimmers colliding
4. The risk of other injuries resulting from participating in any action in the pool. I recognize and fully understand that the above list is not a complete or exhaustive list of all possible risks; the list only provides examples of types of risks that I am assuming. In exchange for the Owner allowing me to utilize the pool and area during my stay, I hereby agree to the conditions below. I fully intend and choose to give up the legal rights, as stated below:
5. TO WAIVE ANY AND ALL CLAIMS that I have or may have in the future against the Owner, its directors, officers, employees, agents, or representatives (hereinafter referred to as the ) relating to my use of the pool and pool area.
6. TO RELEASE THE RELEASEES from any and all liability for any loss, damage, injury, expense, or other cost that I may suffer or that my next of kin may suffer in connection with my use of the Releasees pool or pool area to any cause whatsoever, INCLUDING NEGLIGENCE ON THE PART OF THE RELEASEES.
7. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability to property, or personal injury to, any third party, resulting from the use of the pool or pool area.
8. That I am over the age of 18 and that I am responsible and will adhere to all the rules of the property.
9. That this Waiver, Release, and Agreement is fully effective and shall be effective and binding upon me, and my heirs, next of kin, executors, administrators, and assigns, or anyone else authorized to act on my behalf or on behalf of my estate. I have read and understood this document. I am waiving certain legal rights that I may have against the Releasees, and I fully agree to do so.

This home accepts dogs only with a max of 3 dogs being allowed in the home. We prefer dogs that are less than 20lbs each, but will consider larger breeds. There is a nonrefundable $150 plus tax fee per dog that is brought and this money will be requested after a booking has been made as Airbnb does not collect this fee for us. You dog(s) must be crated when you leave the home.

The standard occupancy number of guests is 14 for this home. We do consider any and all people staying in the home as a guest regardless of age.

Pool heat is available for $50 per day plus tax; must be requested and paid for in advance. If you want pool heat, you must pay for the heat for the duration of your stay. The fee will be requested via the Airbnb resolution center and must paid for before we will turn the heat on.

Please remember to not park anything of any kind in the yard at any time or drive through the yard, please don't park in the street or cul-de-sac (all cars, golf carts etc must be parked in the garage & driveway only). The golf cart must be parked in the garage overnight.

Remember to refill the golf cart with gas prior to departure.

Guests are responsible for filling propane tanks for the outdoor grill and cleaning the grill after each use. If the grill needs to be cleaned upon your departure, our cleaning company charges $200 for grill cleaning and that will be billed to the booking party.

There is a ring doorbell camera on this property as well as a camera in the backyard for the safety and security of the home and our guests.

*Please note this home does not have cable TV nor local channels. Only streaming through the smart TV's is available and you must use your own streaming accounts. 

Additional Information: -No smoking or vaping and no events allowed.

-Guests must be 25 years of age or older to rent and are required to email a photo ID at the time of booking. The guest making the reservation must also be present for the duration of the stay.

-Third party bookings are NOT allowed.

-A signed rental agreement, pool waiver, golf cart waiver and full payment are required to confirm your reservation. Arrival information will not be released until both requirements are completed. Once all requirements have been met, your door code will be provided through the Happy Guest platform at 12:00 PM CST on your arrival day. Additional property details will become available after the rental agreement has been signed and a valid ID has been submitted.

-Check-in is anytime after 5 PM Central Time. You may request an early arrival for an additional fee; however, please note that it is not guaranteed, as it depends on the availability of the unit after morning check-outs and the cleaning & inspection schedule. If you require an early arrival, you may consider booking for the night prior.

-Check-out is strictly at 10 AM Central Time. Any departure after this time will result in an additional fee.

-Quiet hours are 10pm to 7am per the Bay County Noise Ordinance

-Please understand that Florida's natural environment includes bugs, insects, ants, mosquitoes, and spiders. We perform regular interior and exterior pest control, but keeping doors, windows, and sliders closed will help prevent entry. No refunds will be issued for sightings of bugs or wildlife in or around the property.

-Supplies: We provide a starter pack of supplies, including 1 roll of toilet paper per bathroom, 1 roll of paper towels, 2 trash bags for the kitchen, 1 packet of dish detergent, 1 small bottle of dish soap and 1 packet of laundry detergent, to get you started. For additional supplies, there are nearby stores. This is meant to get you through your first day or so until you can get to a store.

-By renting this home you acknowledge that you understand you enter and occupy the premises at your own risk and that the homeowner and Sun & Sand Rentals are not and will not be responsible for injuries or deaths that may occur on our property. You, and all of your guests attending, agree that everything you use is at your own risk, including any beach equipment left on the property. By renting this home, you agree that you are also financially responsible for any third party damages that are caused by your group. Neither the homeowner or Sun & Sand Rentals are liable, financially or otherwise, for any accidental or intentional third party damages your party causes.

RENTAL RULES: 

1. Smoking inside the home is strictly prohibited. If you are caught or reported smoking any illegal substance inside the home, on the porch, or on property, authorities will be called and action will be taken. You will be escorted out of the home and off of the property. Absolutely NO REFUNDS will be given. These are private homes and medical marijuana is not allowed to be smoked in any privately owned home or balcony/patio. 

2. People other than those in the Guest party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of Guest. If caught, you may be evicted without any refund, no exceptions.

3. All of the units are privately owned; the owners and property management company are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners and Property Management Company are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise. 

4. Keep the property and all furnishings in good order. 

5. Only use appliances for their intended uses. 

6. Pets are allowed under the following conditions: max 3 dogs that are under 20lbs each. There is a $150 fee+tax per pet. This fee will be requested through Airbnb after a booking has been made as Airbnb does not collect this fee for us. Please clean up after your pet has used the yard. Please bring and use waste bags to clean up after your pet, throw the waste in either of the two garbage bins on the side of the home. If dog waste is found after your check out, there will be a fee of $100 charged to your credit card. 

7. Parking: ABSOLUTELY NO PARKING IN THE STREET. Please plan your vehicles accordingly. The garage can fit one vehicle. The driveway can accommodate 1-3 vehicles depending on the size of vehicle. If you are driving a larger SUV/truck, you may only be able to fit 2 vehicles in the driveway. The neighbors will complain about this and it will cause an uncomfortable situation resulting in Property Manager needing to evict Guests from the property. We cannot stress this issue enough. Since there is no parking in the cul-de-sac/street, this should go without saying, but do not block any neighbor's drive way either. No parking is allowed in the yard at any time. This means vehicles, motorcycles, golf carts, etc. NOTHING CAN BE PARKED ON THE LAWN.

8. Golf Cart Usage: You are required to sign a golf cart usage waiver. This will be sent in a separate email. This must be signed in order to use the golf cart. Please only use the golf cart to go to/from the beach and local restaurants/entertainment. The golf cart is a street legal vehicle and can only be operated by a guest who has a valid driver's license. ABSOLUTELY NO drinking and driving will be tolerated, you are not allowed to take the golf cart on Panama City Beach Parkway, please limit use of the golf cart to Front Beach Road and the local neighborhood. If any of the rules set forth in the golf cart usage waiver are found to be broken, privileges of using the golf cart will immediately be revoked. Please also be respectful of the neighbors in the neighborhood by keeping driving of up and down the street to only going to the beach/restaurant/entertainment and not continually driving up and down the street for joy rides.   

9. Housekeeping & Arrival: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We do not permit towels or linens to be taken from the unit or for use on the beach or by the pool. We suggest you bring your own beach towels for use at the beach and/or pool. The day before your arrival you will be emailed arrival instructions and a door code. Do not go to the home before your check-in time, while the housekeeper is cleaning or you will take the home as is. This is a larger home sleeping a maximum of 14 guests, please understand the cleaner is working their hardest to make sure the home is perfect and clean for your arrival. We do not want to rush them at all by arriving early. 

10. Pool Armbands: N/A

11. Grills: A gas grill is provided for your stay as well as the propane. If you have any issues, please call our office. If we do not answer, please email us and we will return your call as quickly as possible. It is required of the guests to clean the grill after each use AND prior to departure. If it is found that the grill was not cleaned upon departure, there will be $200 fee charged to the card on file.

12. Water and Septic: The septic system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at any time. If it is found that feminine products have been flushed and clog the septic system, you will be responsible for covering the cost of the repair bill. 

13. Storms:  If there is a storm or hurricane, no refunds will be given unless:  The state or local authorities order mandatory evacuations in a "Tropical Storm/Hurricane Warning area" and/or A "mandatory evacuation order has been given for the Tropical Storm/Hurricane Warning" area of residence of a vacationing guest. The day that the authorities order a mandatory evacuation order in a "Tropical Storm/Hurricane Warning," area, we will refund: Any unused portion of rent from a guest currently registered; Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten the stay, to come in after the Hurricane Warning is lifted; and Any advance rents collected or deposited for a reservation that is scheduled to arrive during the "Hurricane Warning" period. This will be processed as soon as Sun & Sand Rentals can depending on the severity of the storm and any power outage issues. 

14. Washer and Dryer: There is a washer and dryer for your use in the home. Please do not overload the washer and/or dryer. Please remember to clean the lint trap in the dryer before each use. If a repairman has to come out due to overloading or breakage of the washer and/or dryer the guest will be responsible for the repair bill. Please note fees may go up if the repairman has to come after hours (5pm-9am.) No detergent, fabric softener, or dryer sheets are provided, therefore you will need to bring your own.

15. Dish Washing Soap/Trash Bags/Toilet Paper: You will need to provide your own dishwashing soap, trash bags, paper towels and toilet paper. Only 1 trash bag per trash can will be provided as well as only 1 roll of toilet paper per bathroom, 1 roll of paper towels and 1 pod for the dishwasher. Please throw away all trash upon leaving the unit at check-out. This includes, but is not limited to the kitchen, food, and bathrooms. 

16. Trash Days: Trash is picked up on Tuesdays and Fridays. Please make sure all of your trash is in the cans on the outside of the home prior to these pick up days. Trash service is valeted, so no need to pull the cans to the road. Please utilize these trash pick up days as much as you can so when you depart there is minimal trash left and the next guest has at least 1.5 cans to use for their trash before the next trash pick up day. 

17. No fireworks are permitted on the property. Failure to abide by this rule will result in the guests’ immediate expulsion with no refund of unused rent or deposit. 

18. Quiet Times: Please be courteous to the neighbors of this neighborhood. Quiet times are considered 10pm to 7am. We encourage the least amount of complaints as possible from the immediate neighbors. 

19. Any reservation obtained under false pretense will be subject to forfeiture of advance payment, and/or rental money, and the party will not be permitted to check-in. Likewise, guests who have already checked-in and who are found to have used the premises under false pretenses will be subject to further legal action to recoup costs which exceed the amount of the security/damage deposit. By signing this agreement and/or sending a deposit to hold a chosen date, I agree to all terms and conditions of this agreement. I further state that I am at least twenty-five (25) years of age, will be the principal guest, and will be present for the entire length of stay and, as such, will be completely responsible for the actions of other guests, if any, for whom I may be  making these arrangements. The guest agrees to the terms of this Short Term Rental Agreement, as evidenced by the signature below. Please email the agreement back signed with a picture of your ID. 

Please note this home does not have cable TV nor any local channels. There is only streaming apps on the TV's and you will need to log in with your own accounts.
