TERMS & CONDITIONS PART I – RENTAL TERMS This Rental Agreement (sometimes referred to herein as “Agreement”) must be completed, signed, and returned within 5 days from the Origination Date of the Reservation. Included with this electronically signed Rental Agreement, we will also need a copy of your government-issued ID so we may verify the name on the Reservation matches your identification that shows you are at least 25 years of age. If not returned within the 5-day period, the reservation will be canceled, and your money refunded minus $100.00. If the Origination Date of your Reservation is within 15 days of your Check-In Date, there will be no refund, and your Reservation will not be honored Last Minute Reservation Policy (Reservations created within 7 days of arrival date) If the origination date is within 7 days of your Check-In Date you will be required to send a live selfie at the unit door (with unit number visible) to receive your access codes. Payment Payment - 1/3 of the total amount is due immediately to hold your Reservation and full payment is required 60 days prior to Check-In Date. 60 days prior to Check-In, we will charge your credit card for the balance due. (Please note - All monies collected from you will be placed in an interest-bearing account. All interest will accrue to My Vacation Haven). If you are booking your Reservation within 60 days of the Check-In Date, then full payment is due at the Origination Date. FALSIFIED RESERVATIONS - Any Reservation obtained under false pretense will be subject to forfeiture of advance payment and/or rental money and you will not be permitted to check in. Check-In Time Check-In Time begins at 4PM Central Time. At that time the electronic door lock will activate. Due to our high standard of cleanliness, there is a possibility that all accommodations might not be ready at check-in time. If your accommodation is not ready, we would appreciate your patience while we complete our cleaning process. There will be no discounts offered due to a late Check-In. Check-Out Time Check-Out time is 10AM Central Time. No late Check-Out. You must depart at the appropriate time. The electronic door lock will deactivate at that time. Cancellation If your Check-In Date is more than 15 days from your Reservation Origination Date you may cancel up to 5 days after the Origination Date of your Reservation with a minimal charge of $100.00. After 5 days from the Origination Date, My Vacation Haven will not issue a refund of your Reservation payment. If the Origination Date of your Reservation is within 15 days of your Check-In Date, My Vacation Haven will not issue a refund of your Reservation payment. If the origination date is within 7 days of your Check-In Date, you are required to send a photo of yourself in front of the property to receive your access codes. Hurricane Policy Should a hurricane or tropical storm threaten our area we will receive evacuation instructions from the National Hurricane Center and our local governing officials. If the Mandatory Evacuation order is given. My Vacation Haven will not issue a refund of any rent payments. We strongly recommend purchasing Travel Insurance. Security Deposit In lieu of payment of a Security Deposit, Guests shall supply a major credit card to be charged the cost of repair or replacement of items or other damage to the Rental Property caused by Guests or its invitees beyond ordinary wear and tear. As the Guest, you agree to reimburse the Owner for any damage to the Rental Property caused by you, your invitees, or others. Damages shall include reasonable attorney fees and court costs incurred by Owner or My Vacation Haven as its Agent in enforcing this section. You as the Guest shall be responsible for and assume all liability for damage, defacement, or removal of property inside or outside the Rental Property that is in the Guest’s control, unless the damage, defacement or removal is due to ordinary wear and tear, acts of the Owner or Owner’s Agents, or due to natural forces. Your signature on this Rental Agreement authorizes My Vacation Haven to charge your credit card accordingly. Please report all damaged and/or broken items to the My Vacation Haven office ASAP Repairs All Properties are inventoried and inspected before and after Guest occupancy. We try to make sure everything is in good repair prior to your Check-In, but in the event, there are any housekeeping, damage, or maintenance issues, please report them immediately to avoid additional charges and to make sure your stay is enjoyable from the beginning. Properly working appliances, electronics, HVAC, elevators, etc. are not guaranteed. We do have a 24/7 helpline and any repairs we are able to handle will be made as soon as possible as needed. No compensation or credit will be given for temporary outage of electricity, gas, water, cable or other utilities. Outages should be reported immediately, and all efforts will be made to have them restored as soon as possible. Refunds Refunds of the advance rental deposit and/or the total rental fee (including fees & taxes) will not be given for late Check-Ins, early Check-Outs, or inclement weather conditions. Substitution My Vacation Haven properties are privately owned properties and subject to the reasonable wishes of the Owner. Properties are occasionally removed from our rental program on short notice due to changes in ownership or other changes made by the Owner or the properties may become uninhabitable due to unforeseen maintenance issues. Although we will do our best to fulfill your specific request, it is not guaranteed. At the time your Reservation is confirmed, we reserve the right to change the assignment to a comparable Rental Property. Should this occur to a confirmed Reservation, every effort will be made to contact you by telephone or e-mail to inform you of the need to change your Reservation to another suitable accommodation. Please be assured you will be moved to a comparable Rental Property, at our discretion, depending on Rental Property availability. In some cases, a comparable Rental Property may not be available due to the unique nature of the request (e.g. penthouse units); in which event My Vacation Haven may offer you the next best comparable Rental Property, reschedule your Reservation, or offer you a refund. No two properties are the same. Inventories and furnishings are subject to change without notice PART II – RULES AND REGULATIONS Maximum Occupancy The maximum number of Guests is listed in the description. Additional occupants must be approved by My Vacation Haven and additional charges may apply. Age We will not rent to anyone under 25 years of age unless accompanied by an adult guardian or parent who will be staying overnight, all nights, in the Rental Property with the occupants under 25 years of age. Unlawful Activity Guests and any invitees of Guests shall obey all the laws of the state of Florida and local laws, at all times while they are on the Rental Property including common areas of the resort. Failure to abide by the laws of the state of Florida or the rules incorporated herein, may cause Guests and invitees to be vacated from the Rental Property and forfeit all rents and security and/or deposits. No underage drinking or partying is allowed on the Rental Property. If My Vacation Haven is made aware of these activities, we will be forced to remove the Guests from the Rental Property. All rental payments and deposits will be forfeited. Guests and invitees in violation will be removed by local law enforcement or the security company employed by the resort. Notice regarding the County’s Noise Ordinance (Article 5 – Noise, Walton County Code of Ordinances) and potential civil infraction fines up to $500.00 and/or potential criminal offense violation between the hours of 10:00 p.m. and 6:00 a.m. Transient occupants must evacuate from the short-term vacation rental upon posting of any emergency evacuation order issued by local, state, or federal authorities. Weapons Not Allowed Weapons of any kind are prohibited on and around Rental Property. Guests shall not bring any weapons of any kind on to or into the Rental Property. Any weapons left at the Rental Property by a Guest will be removed and turned over to the proper authorities at the Guest’s expense. Any Guest who brings a weapon to the Rental Property will be held strictly liable for any damage caused to any person or property harmed by the weapon. Guests specifically hold My Vacation Haven LLC, and the Rental Property owner harmless from all damages, whether actual, consequential, or punitive in nature, arising from any claim resulting from use or misuse of any weapon of any kind. If a Guest purposefully or inadvertently brings a weapon to the Rental Property, the Guest agrees to remove the weapon immediately. While My Vacation Haven inspects each Rental Property after each visit, it is not possible for inspectors to find weapons hidden from plain sight, which may later be found by a subsequent Guest or their children. Therefore, the Guest understands that My Vacation Haven has a zero-tolerance weapons policy and does not allow any weapons of any kind on to its Rental Property. Neighborhood/HOA Rules Including Parking and Trash Violation Most rental Properties are located within neighborhoods controlled by a homeowner or condo association. The associations have rules and regulations in place to keep all Owners and Guests safe, and these rules must be always followed. If you have questions, please contact My Vacation Haven to ensure compliance. If rules are not followed, then the Guests will be responsible for actions and/or fines enforced. BIKE RENTALS As a renter in The Destiny by the Sea neighborhood you are responsible for abiding by the following items or will be fined $250 by the HOA: *Destiny by the Sea does not allow bike rentals in the community. *All beach items need to be put away every day after use, can not be left by front door. *Trash cans must be put back in place, organized and tidy. WEDDINGS The Destiny by The Sea HOA charges an additional $600 wedding fee due directly to the HOA. There is a $1000 fine for unregistered weddings and a $100 fine for unregistered pets. Please contact My Vacation Haven for registration and payment directions if needed. PRIVATE POOLS The pool equipment is on automatic timers. Do Not touch under any circumstances. Prohibited Vehicles The following vehicles are not allowed on the Resort Properties: RVs, motorcycles, trailers of any kind, unregistered, non-Sandestin Property Owner golf carts. Smoking/Pets/Grilling All Properties are NON-SMOKING PROPERTIES. Violators will be charged a fine of $750. Pets are NOT PERMITTED in Rental Properties under any conditions unless Rental Property is designated as dog friendly, and this is accompanied by a fee. Violators will be charged a fine of $750. If a pet causes damage in a non-pet friendly Rental Property, you will be held responsible for the cost of any damage caused by a pet. No gas or charcoal grilling is allowed in Rental Property or on balconies unless Rental Property is designated for grilling. Pool Rules Please be advised that there may be a swimming pool and/or hot tub located in the neighborhood or on the premises of some of our rental properties. NO lifeguard/safety personnel are provided. Guests use the pool and other amenities at their own risk! Guests agree to indemnify and hold harmless My Vacation Haven and the Owner from any claim/loss or expense (including attorney's fees and court costs) by Guest or Guest invitees. Diving or jumping into the pool or hot tub may result in head, neck, or spinal injuries. As the renter, you accept the risk of the pool and specifically agree that no minor will swim in the pool unaccompanied by an adult. Pool heat at private home pools, if it is available, is offered seasonally between October and Early May, however, pools cannot be heated if the temperature is below fifty-two (52) degrees or above eighty (80) degrees. For an additional cost the pool can be heated. Pool Heat must be purchased for the entire/duration of stay and will be billed at the time of request for units that have a heater. Please contact My Vacation Haven for details about the additional cost. Allow forty-eight (48) hours for pool heater to heat the pool water to the set temperature. Tampering with pool equipment may result in injury and/or a fine. All pool equipment must be operated by a licensed professional. Outdoor Policies The pool is to be used by registered Guests and Guest invitees only. No glass allowed in the pool area. There are no pool hours at private home pools, however, please be considerate of neighbors. Neighborhood pools will have rules posted with varying hours, and all rules should be followed. Please rinse off sand using an outdoor shower before you enter the pool and when returning from the beach. Music volume must be kept at a reasonable level. Doorbell Cameras and Surveillance on Rental Property Guests understand that some Rental Properties may include a doorbell camera or other surveillance equipment on the exterior of the premises. Guests agree that they have no expectation of privacy on the exterior of the Rental Property, including patios, porches, pool decks, and other appurtenances. Any violation of the rules, regulations, policies, or other inappropriate activities captured on a surveillance or security camera will be reported to the appropriate authorities and may result in charges against your credit card for damages. Initial Supplies Your Reservation includes a one-time linen and towel set-up, an initial set up of trash liners, bathroom paper, paper towels, hand soap, laundry, and dishwasher detergent. We do not permit towels or linens to be taken from Rental Property. My Vacation Haven reserves the right to charge for lost or damaged linens. Beach Towels Bring your own beach towels. We do not permit towels or linens to be taken out of the Property. Parking Pass You will be given a parking pass at the Security Gate for the gated Resort properties upon initial Check-In to the Property. The parking pass will be valid for your entire stay and must be displayed on the dash of your vehicle. Check-Out Instructions To avoid additional charges upon Check-Out:

• All garbage and debris must be removed from Property and properly disposed. (Be sure to follow neighborhood rules where applicable.)
• All soiled dishes shall be placed in the dishwasher, and the dishwasher must be started (where applicable).
• Close and lock all outside doors and windows.
• If you leave items in the Property and wish to have them returned, you will be responsible for the shipping charges. My Vacation Haven is not responsible for personal items lost.
• Please leave Property as you found it; excessive Check-Out cleaning may be an additional charge.
• If you stay in the Sandestin Golf & Beach Resort, you will have shuttle cards in terms of how many bedrooms the rental has. Please leave that same number of shuttle cards in the rental when you leave, or you will be charged $10.00 per missing shuttle card.
• If you are staying in Westwind’s, Beachside I, Beachside II, or Luau, then you will have the exact number of pool bracelets in the condo as can sleep in the condo. So, please leave that same number of bracelets in the condo when you leave, or you will be charged $10.00 per missing bracelet.
• If you are staying in Harbour Point, there is a pool key hanging in the condo upon arrival. You must leave this pool key in the same place in the condo upon departure, or you will be charged a $100 pool key replacement fee. Important If your accommodation is at the Sandestin(R) Golf and Beach Resort this Reservation does not include the Sandestin(R) amenity card/Resort Key Card. MY VACATION HAVEN is an independent company that is not affiliated with, sponsored by or associated with any entity containing the word “Sandestin.” Any use or reference to the word “Sandestin” is in the dictionary or factual sense to identify a property or location and not to suggest any affiliation with any SANDESTIN(R) branded entity, product, or service. PART III – MISCELLANEOUS Authorization to Charge Credit Card My Vacation Haven reserves the right to charge the credit card that was used to process this Reservation for any damage done to the Property, its contents, any items missing, and any fines incurred during your stay resulting from violation of rules. Golf Cart Addendum PART IV – GOLF CART USE -if applicable In consideration of being allowed permissive use of the golf cart located on the real property for the recreational activity of driving the said cart only on the golf cart approved roads, underpasses, sidewalks, and parking areas within the community, the undersigned, his/her/and their personal representatives, heirs, next of kin, children, Guests and spouse agree as follows: I/We do now remise, release, acquit, satisfy and forever discharge the Owner(s) of the golf cart, Owner of the Real Property, their heirs, assigns, personal representatives, managers, and agents, including My Vacation Haven, LLC and its employees, managers, members, and representatives (collectively, “Releasee”) from all actions, causes of action, suits, controversies, trespasses, damages, judgments, claims and demands whatsoever in law or in equity, which I/We ever had, now had or may have in the future, or which any personal representative, successor, heir or assign of mine/ours in the future can, shall or may have, for any reason or cause whatsoever, including but not limited to any and all claims, causes of action, suits, controversies or demands, including the negligence of the Releasee, arising out of or relating in any fashion whatsoever to my/our use or having the right to the use of the said golf cart. I/We covenant not to sue or otherwise assert a claim of any nature whatsoever against Releasee arising out of or in any way related to my/our use or having the right to the use of the said golf cart. I/We understand and comprehend the risk associated with my/our use or having the right to the use of the said golf cart and I/We assume full responsibility for any risk of bodily injury, death, of property damage arising out of my/our use or having the right to the use of the said golf cart or all others’ use of the said golf cart and all whether caused by the negligence of the Releasee or otherwise. The undersigned releases all rights to the use of the said golf cart at the time that the undersigned releases all rights to and in the Rental Property/ The undersigned certifies and agrees that he/she/they will carefully examine the said golf cart prior to each use of the same, and that the undersigned’s participation in the use of the said golf cart will automatically indicate the undersigned’s acceptance of the conditions of the said golf cart as being reasonable and safe for the purposes for which it is used, and the said golf cart is accepted in an “AS IS” condition without any Reservation, limitation, or warranty, expressed or implied. The undersigned acknowledges that Releasee have made no warranty, express or implied, regarding the condition of the golf cart. The use or non-use of the said golf cart shall not have any effect or influence on the rental, term, or rent due on the Rental Property. The undersigned certifies that he/she/they have examined the golf cart or have used similar golf carts and are familiar with the same and that he/she/they are capable and skilled in the use of golf carts. The undersigned acknowledge that he/she/they have read or are familiar with and also have agreed to obey and abide by the rules, regulations, and directions on the use of the golf cart as promulgated by the Owners, the Owners’ Agent, My Vacation Haven, LLC, all applicable homeowner’s associations, Police, Security personnel, Miramar Beach, Florida, Walton County Sheriff’s Department, the United States of America, and all other governmental regulations. For the purposes of this Agreement, the Sandestin Golf and Beach Resort® include the shopping and restaurant area known as “Grand Boulevard Town Center. The undersigned promises to obey and abide by the Owners’ rules are as follows: All drivers must be 16 years of age or older and hold a valid driver’s license. Guests will be responsible for any damage due to improper use of carts or underage drivers. A copy of each user’s driver’s license must be provided with this signed Agreement. All drivers must know and appreciate the “Rules of the Road”, including the obligation to keep a proper lookout, keep the golf cart under control and drive at a speed no greater than is reasonable and prudent under the circumstances. Drive and park only in designated areas. Not drive outside of the resort area. Not driving on Highway 98. Read and obey all the Rules and Regulations of all applicable homeowner’s associations. Drive safely and be considerate of others. Not drive the golf cart if it is not operating properly and report the same to the Owners’ If the subject golf cart is damaged or destroyed as a result of the use of the same by the undersigned, then the undersigned promises and agrees to promptly repair or replace the subject golf cart to or with a like quality golf cart. Guests will be responsible for any damage due to improper use of cart or underage drivers or more people on the cart than it is designated to hold. The undersigned shall hold the Releasee harmless from all Third-Party Claims resulting from the undersigned’s use of the said golf cart, including all costs, expenses, attorney’s fees, or all other liabilities. If any provision or any portion of any provision of this Agreement, or the application of any such provision or portion of a provision to any person or circumstance, shall be determined to be invalid or unenforceable, then the remaining portion of such provision and the remaining provisions of this Agreement, or the application of such provision held invalid or unenforceable to persons or circumstances other than those to which it is held invalid or unenforceable, shall not be affected by such determination. The terms and provisions of this Agreement and any dispute arising in connection with this Agreement shall be governed by and construed in accordance with Florida law. The parties agree that the venue for any legal action filed in connection with this Agreement shall be in Walton County, Florida. In connection with any litigation arising out of this Agreement, the prevailing party shall be entitled to recover all costs and expenses incurred, including reasonable attorney’s fees. If married, then both spouses are required to sign this Agreement and provide a copy of their driver's license. Further, all persons who intend to drive the golf cart and are 18 years of age or older, must sign this Agreement and provide a copy of their driver's license or they forfeit the right to drive the said golf cart. This Agreement is provided to the User as a courtesy on behalf and upon the direction of the Rental Property and golf cart Owner(s) and shall not be construed to be an endorsement or approval of golf cart use. The user accepts responsibility to read and understand the rules, regulations, restrictions, laws and other governing documents pertaining to golf cart use within the resort and within Walton County, Florida. My Vacation Haven, LLC has no liability whatsoever regarding golf cart use and is in no way responsible for providing user or Rental Property Owner and/or golf cart Owner with copies of any applicable rules, regulations, restrictions, laws, and other governing documents pertaining to golf cart use. The parties have asked My Vacation Haven, LLC to facilitate securing signatures on this document as a courtesy to them and in no way do the parties expect My Vacation Haven, LLC to accept any form of liability regarding golf cart use, property damage, personal injury, theft, or other loss, tort, or damage. The parties to this Agreement have assured My Vacation Haven, LLC that all drivers are listed herein, all drivers are insured, and that any driver under the age of 18 will be under the control and responsibility of the adult parties to this Agreement. All drivers assume their own risk and agree that the information provided to My Vacation Haven, LLC is accurate and complete, whether in this document or through written or email communication, or by verbal communication; therefore, My Vacation Haven, LLC may, in good faith, rely on the information provided by the parties. Golf cart key(s) must remain in the property upon guest departure. If a key is taken or lost, guests will be charged $250 per key replacement. Key(s) must be overnighted back to My Vacation Haven. The My Vacation Haven agent or authorized persons may enter the Property to make repairs. Agency My Vacation Haven is the Agent of the Property Owner and is always acting, in and for the best interest of the Property Owner and My Vacation Haven, LLC. My Vacation Haven will not be held responsible for acts of theft, vandalism, or damage to Guest's personal property. Special Events Weddings and special events must be approved by the Owner and homeowner's association. A Reservation does not obligate the association to approve an event. Please contact My Vacation Haven if you need assistance with a special event. Guests shall not have parties or events at the home without obtaining prior written approval from My Vacation Haven. Weddings, cocktail parties, receptions, welcoming events, etc. may require Owner approval, payment of additional fees and an additional written agreement. Occupants Please list the full name and ages of all additional Occupants staying in the Property. Hold Harmless Neither My Vacation Haven nor Owner assumes any liability for loss, damage or injury to persons or their personal property, nor for any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, electricity or plumbing, as well as due to weather conditions, natural disasters, acts of God, or other reasons beyond their control Additional Terms and Conditions The undersigned Guest, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges My Vacation Haven and Owner from any and all liabilities, claims, demands and causes of action by reason of any injury, loss or damage by whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her invitees as a result, or in connection with the occupancy of the Property and agrees to hold My Vacation Haven and Owner free and harmless of any claim or suit arising therefrom. In any action concerning the rights, duties, or liabilities of the parties to this Agreement, the principals, agents, successors, or assignees of the prevailing party shall be entitled to recover reasonable attorneys’ fees and costs, through all appeals. This Agreement shall be governed by and construed and enforced in accordance with the laws of the State of Florida. My Vacation Haven reserves the right to terminate this Agreement upon its discretion at any time. This Agreement may be signed electronically. This Agreement may be signed in counterparts. Legible fax copies scanned copies and photocopies of documents signed by either party are deemed to be equivalent to originals. Comments My Vacation Haven reserves the right to edit comments on Website and all Social Media outlets. Binding Nature of Agreement All the terms, covenants and conditions of this Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective heirs, legal representatives, successors and assigns. Headings Any headings used in this Agreement are for convenience of reference only and shall not be construed to alter or affect the meaning of any of the provisions. All references to the singular shall include the plural, and vice versa. The parties agree that this Agreement is the result of negotiation by the parties, each of whom was represented or had the opportunity to be represented by counsel, and thus, this Agreement shall not be construed against either party because of authorship. Time All time periods shall be calculated on calendar days. Time is of the essence in this Agreement. Written Exceptions Any exceptions to the terms of this Agreement must be approved in writing in advance by My Vacation Haven. Subject to Change Accuracy of printed, published or web-based material, including rates, outside of this Agreement are not guaranteed and are subject to change. IMPORTANT INSTRUCTIONS AND SIGNATURES I/WE HAVE READ THIS COVENANT NOT TO SUE, RELEASE, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, I/WE FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I/WE HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME/US AND INTEND MY/OUR SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF RELEASEE TO THE GREATEST EXTENT ALLOWED BY LAW. This Rental Agreement must be signed and returned within 5 days from the Origination Date of the Reservation. If not returned within the 5-day period, the Reservation will be canceled, and your money refunded minus $100.00. If the Origination Date of your Reservation is within 15 days of your Check-In Date, there will be no refund, and your Reservation will not be honored. If the origination date is within 7 days of your Check-In Date you are required to check in at our office at 600 Grand Blvd, Ste 209 Miramar Beach FL, 32550 to receive your access codes. • Read this Agreement in full. • Fill in your Guest list and note ages. • Sign and date it electronically. • Upload your government-issued identification.
