This Rental Agreement ("Agreement") is entered into by and between Property Management of Hayward, Inc. (PMH), as agent for the owner of the vacation home property and the tenant(s) named ("Renter"). This Agreement grants Renter the limited use and occupancy of the vacation home property. In consideration of the mutual promises and obligations contained herein, the sufficiency of which is hereby acknowledged, PMH and Renter agree to the rental of the vacation property under the rates, terms, and conditions set forth below.
Rental Term The lease term shall be for the dates specified in the online booking portal, which are incorporated by reference into this agreement.
Check-In and Check-Out Check-in is at 4:00 PM unless earlier access is granted by Property Management of Hayward (PMH). Check-out is at 9:00 AM. A fee of $50 per hour (or portion thereof) will be charged to the guest for late check-outs. Unless other arrangements are made, keys must be returned to the lockbox and the property secured upon departure. Early check-in and late checkout cannot be guaranteed. Some homes use keyless entry with no physical keys.
Reservation Deposit All reservation deposits are dictated and enforced by the online travel agency (“OTA”) through which the booking was made. No alterations, exceptions, or independent arrangements regarding deposit terms will be made outside of the OTA’s established policies.
Damage Waiver Fee A mandatory, one-time Damage Waiver Fee of $50-$150 (Depending on property) will be charged to the Guest in addition to the rental rate. This Damage Waiver provides coverage for accidental damages to the property up to a total amount of $750 per stay. Coverage Provided: The Damage Waiver covers accidental and unintentional damage that may occur during the Guest’s stay and that may be considered normal wear and tear or minor risks, including but not limited to: • Scratches on doors, walls, or floors • Stains or spills on carpets, upholstery, or furniture • Broken glasses, tableware, or minor furniture damage Reporting Requirement: Guests must report any damage that occurs during their stay prior to checkout. Failure to report incidents before departure may result in the damage being treated as non-covered, and repair or replacement costs may be charged to the Guest. Exclusions (Not Covered Under the Damage Waiver). The Damage Waiver does not cover the following: • Intentional or negligent damage, including damage caused by serious carelessness, misconduct, or unauthorized activities (including but not limited to parties or events not approved by the Owner). • Damage resulting from violation of house rules, including but not limited to: 1. bringing pets into a no-pet rental 2. smoking in a no-smoking area3. allowing unauthorized guests to stay • Damage to a Guest’s personal belongings, including loss or theft of personal items. • Bodily injury to any person. Additional Charges: If the total cost of accidental damages exceeds the $750 coverage limit, the Guest agrees to pay any remaining balance. The Owner or Manager reserves the right to charge the Guest’s credit card on file or invoice the Guest for any non-covered damages or violations of this Agreement. Acceptance: Payment of the Damage Waiver Fee and occupancy of the property constitutes acceptance of this Damage Waiver Agreement and all terms contained herein.
Items Provided The property comes equipped with the following basic supplies: • Linens • Kitchen essentials • Several rolls of toilet paper and paper towel • Trash bags • Dish soap and dishwasher detergent If these supplies run out during your stay, it is your responsibility to purchase more. Only septic friendly toilet paper is allowed at the property.
Items NOT Provided The renter is responsible for supplying the following items (including but not limited to): • Kitchen, bath, and swimming towels(If property notates "limited essentials" this applies,if it does not the property comes with towels) • Personal bath soap and laundry detergent • Life jackets (if watercraft is included with the property)
Housekeeping The property is professionally cleaned before arrival, and fresh linens are provided. No daily housekeeping or linen services are included. Weekly trash pickup is provided for rentals longer than one week. Renters must leave the home in the same condition it was received (reasonable wear and tear excepted). Locked areas such as owner storage are off-limits and tampering may result in deductions. A one-time cleaning fee is charged for every stay.
House Rules These rules are part of this agreement. • No smoking or vaping is permitted indoors • No pets are allowed unless pre-approved • No fireworks are allowed on the property Violation of the fireworks rule will result in a $500 fine per occurrence, and the renter is liable for any damage caused to the rental property or neighboring properties. • Evidence of smoking, vaping, or pets will result in a $500 per day fine plus damage costs • No refunds will be given for temporary utility outages (e.g., electricity, gas, water, internet, a/c) • Any charges made by the renter to TV, phone, or internet services during the stay are the renter’s responsibility
Liability and Indemnity The renter and their guests agree to indemnify and hold harmless PMH and the property owner from any and all claims, losses, or damages resulting from occupancy or use of the property.
Watercraft Usage Renters may not use any watercraft belonging to the property unless specifically authorized. If permission is granted, renters must use proper life jackets and flotation devices. No warranties are made regarding the safety of the watercraft. Use is at the renter’s own risk. Renters must swim at their own risk.
Responsible Party Subleasing is not allowed. The person who books and signs the agreement must be present throughout the rental period and is considered the responsible party. Unauthorized access or a change in the responsible renter without PMH's written approval may result in eviction. Every guest age 4 and up must be included in the reservation. Undisclosed guests may incur additional charges or eviction.
Grounds for Eviction Immediate eviction and forfeiture of deposits and rents may occur for: • Commercial or illegal use of the property • Behavior disturbing neighboring residents • Unauthorized pets • Fireworks • RVs, tents, or unapproved vehicles on the property • Motorcycles, ATVs, and similar vehicles are allowed for temporary parking only Petapproved properties require an additional pet fee.
Acts of God & Weather No refunds will be provided for inclement weather. If a government-ordered evacuation occurs due to a natural disaster, the renter will receive a prorated refund. If a disaster renders the property uninhabitable prior to arrival, a full refund (minus booking fees) will be issued.
Events and Gatherings No events (e.g., weddings, parties, reunions) are permitted without prior written approval and applicable fees. Some homes prohibit events entirely.
Lost and Left Items PMH is not liable for lost or forgotten personal belongings. Items recovered can be returned for a $50 handling fee plus postage. Unclaimed items are donated after 30 days.
All payments due under this Agreement shall be automatically charged to the payment method on file on the dates specified in the reservation schedule, without further notice or authorization from the Guest.
All reservations are subject to the cancellation policy of the online travel agency (“OTA”) through which the booking was made. Guests are advised to review the applicable policy on the booking platform for full details, as those terms govern any cancellations, refunds, or modifications.
