-Smoking/vaping marijuana inside on the living/kitchen level is allowed. Please use air purifiers in Anion mode when smoking/vaping marijuana inside. No tobacco smoking inside please. All types of smoking/vaping welcome outdoors.
-Close the roof-top deck umbrella when not in use.
-Use grill at least 3ft from the wall.
-No mail to the unit; deliveries are welcome and come to the door.
-No pets or visiting pets please.
- There is a $250 charge if you take the parking pass. We need it for our future guests.
HOT TUB
-Quiet hours between 10PM and 8AM please.
-No unsupervised children in the hot tub.
-Please don't add any additives to the (water, soap, chemicals, etc.)
-Use at your own risk.
- Six (6) person maximum capacity.
- No eating, drinking, or smoking in the hot tub.
- No glassware in or around the hot tub.
- If you have a spray tan do not use the hot tub whatsoever.
- Guests must shower before use of the hot tub. Lotions, sun screen, make-up, henna, soaps, oils or any such products will adversely influence the chemistry levels and/or condition of the hot tub.
- Do not remove the blue canister or white foam bug from the tub.
- Close the tub while not in use for safety reasons as well as to conserve heat.
- Do not take the cover off and put it on the ground.
It’s extremely important to keep debris, such as leaves, food, glass, additives, etc out of the hot tub. Actions that result in the need for a professional drain/refill of the tub at a cost of $500 will be charged to the guest
HOT TUB WAIVER:
RELEASE & WAIVER OF LIABILITY AND INDEMNITY AGREEMENT
IN CONSIDERATION for being permitted to enter premises and property located at this reservation for vacation rental or any other purpose, the signee, for himself/herself, his/her personal representatives, guests, children, heirs, and next of kin, acknowledges, agrees, and represents that he/she has or will immediately upon entering, and will continuously thereafter, thoroughly inspect such areas and his/her continued presence constitutes an acknowledgment that he/she has inspected house, deck, amenities and entire property and he/she finds and accepts such areas as being safe, not misused or damaged and reasonably suited for the purposes of his/her use, and he/she further agrees and warrants that if, at any time, he/she feels anything to be unsafe, he/she and all guests will immediately leave the area and advise appropriate persons.
THE SIGNEE hereby RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE owners of the property, personally and as company or corporate representatives, their members, managers, operators, officials, officers, directors, employees, owners and lessees of the premises, all for the purposes herein referred to as “releasees”, from all liability to the signee, guests, representatives, assigns, heirs and next of kin for any and all loss or damage, and any claim or demand thereof on account of INJURY to the person(s) or property or resulting in DEATH of the signee or guests while in or upon the area. This Release and Waiver of Liability shall not apply to any claims arising from the negligence of the releasees.
THE SIGNEE hereby AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the releasees and each of them from any loss, liability, damage, or cost they may occur due to their presence in or upon the area, unless it’s due to the negligence of the releasees.
THE SIGNEE hereby ASSUMES FULL RESPONSIBILITY FOR RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE while in or upon area, unless arising from the negligence of the releasees.
THE SIGNEE understands that this agreement/waiver is incorporated into, and is part of, the original lease agreement between the parties, or if none such exists, stands as an Agreement on its own.
THE SIGNEE hereby AGREES TO HEED THE FOLLOWING WARNINGS:
- Use of hot tub carries risk that may result in serious injury or death, and unsupervised use by children is strictly prohibited.
- Always cover the hot tub when not in use and secure the straps to ensure the safety of guests.
- Elderly persons, women who are pregnant or who may be pregnant, infants and anyone subject to heart disease, diabetes, low or high blood pressure, strokes, epilepsy or similar afflictions should not enter the hot tub alone and without consulting their physician.
- Never use the hot tub while under the influence of drugs or alcohol.
- To avoid injury, exercise care when entering or exiting the hot tub. Jumping/diving into hot tub is prohibited.
- If you are taking medication of any kind, or being treated for any illness, consult your physician prior to use of the hot tub. Guests with infectious diseases or suffering from diarrhea should not use the hot tub.
- The hot tub should be kept at a temperature less than 104° for personal safety.
- Prolonged immersion (longer that 30 minutes) in the hot tub may be injurious to your health.
- Do not sit or walk on spa cover as it might collapse or be damaged.
- Walking / running while wet or damp holds inherent risks of injury or death. Additionally, it might create dangerous conditions for others, exposing them to the risk of injury or death.
- Before anyone uses the hot tub, the signee agrees to test safety of water by checking temperature and chemical levels. Test strips are provided in the cabinet under the sink. If bromine or pH level are not within an acceptable range, or if you are unsure of how to use the test strips, please contact your hosts and do not use the hot tub. Additionally, use of the hot tub may cause bacterial growth and possibility of contracting communicable skin disorders, and bathers should shower immediately after use.
THE SIGNEE hereby AGREES TO ADHERE THE FOLLOWING RULES OF CONDUCT:

- Do not take the cover off and put it on the ground. Instead, remove the cover using the bracket arm:
- The hot tub has two covers; the thin cover is to prevent damage from the elements for the rigid, heat-containing cover.
- You can open the rigid cover without removing the thin cover. When closing, make sure to pull the thin cover back over the rigid cover.
- There are four clasps on the corners of the rigid cover which should be undone (you might have to push the thin cover up to get to them).
- With a person on each side, lift the cover, folding back the front half onto the back half.
- Tilt both halves toward the back wall - careful as it gets heavy as you progress through the motion. The bracket arm suspends the cover easily, keeping it off the ground.
THE SIGNEE understands by electronically returning this waiver he/she:
- Understands that it is his/her responsibility to inform every guest using the hot tub of these warnings and the rules of conduct, and to insure every person heeds/obeys them.
- Understands that he/she is responsible and liable for any contamination or damages that occur to the spa through their or their guest's misuse or negligence.
- Understands that failure to comply with the stated rules, or any action that adversely influences the condition of the hot tub, be it damage or contamination, may result in forfeiture of any deposits paid and/or paying any additional expenses to restore the hot tub to its prior condition. Damages to the cover could amount to $3,000. Remediating contamination could cost up to $850. Other damage to be assessed on a case by case basis.
- Certifies that he/she and guests (they) have adequate insurance to cover any injury, illness or damage that may be caused or suffered while in or upon area, or else agrees to bear the costs of such damage or injury.
- Certifies that he/she/they have no medical conditions which would interfere with use of hot tub or else assume and bear the costs of all risks that may be created, directly or indirectly, by any such condition and expressly acknowledges such physical activities are dangerous and involve the risk of serious injury and/or death and/or property damage.
- Understands that due to damage or contamination by previous guests, or due to maintenance issues that the hot tub may not be available for use during part of or the entirety of their visit.
- Understands that the foregoing release, waiver and indemnity agreement is intended to be as broad and inclusive as is permitted by law and that if any provision is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
- Agrees that any dispute, controversy or claim arising out of or related to this Agreement or the interpretation of this Agreement shall be settled by arbitration in accordance to the rules of the American Arbitration Association, except to the extent modified below. The place of arbitration shall be Denver County, CO.
THE SIGNEE HAS READ, UNDERSTANDS THE RISKS, AND VOLUNTARILY SIGNS THE RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT, and further agrees that no oral representations, statements, or inducements apart from the this emailed agreement have been made.
