Check-in/Check-out: We will contact you 2 days before your arrival, please let me know if you have any questions or concerns before then. Check-in time is anytime after 4 pm (PST). Checkout time is 11:00 am (PST). Early check in’s and late check out’s are available if requested depending on availability but there are no guarantees of an earlier check-in or late check out. Please assure that all doors, sliders, and windows are securely locked, and lights and heat are turned down if you leave the property for longer than 6 hours. We are not responsible for items left or lost in the rental home, we do not ship any lost or left behind items.

Deposits and Payment. Upon checkout, the property is inspected for damages. Any damages done will be the responsibility of the Lessee. If Lessee receives a citation due to violating the vacation rental ordinance, Lessee's will be responsible for payment to the city for fines up to $5000.

Occupants. We require a copy of a government ID of the lessee. City requires the lessee to be at least 25 years old to rent this property. We do not allow 2nd or 3rd party bookings. You must rent the home for yourself and your guests. Violation of occupancy limits will result in the forfeiture of all monies and termination of occupancy. We reserve the right to inspect the property anytime during your stay. Further, you agree to abide by the rules and regulations of the community and refrain from any activity, which interferes with the quiet enjoyment of its residents. We reserve the right to evict anyone disobeying these rules. The Tenants shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners. Outdoor cameras located front, sides, and back of our properties. Devices record 24/7 for security purposes and can be used to check occupancy, rule breaks and “quiet hours” compliance. (Guest(s) may not disconnect or tamper with exterior Security Cameras.) We require that you respect the reservation you committed to and only have the same number of people stay in the house as listed in their reservation. All guests must be included in the reservation before signing no matter time and length of their stay. Violation of occupancy limits will result in the forfeiture of all monies and termination of occupancy. At all times there must be one adult present with minors on the property. Do not allow children in the backyard without adult supervision.

Pets. Pets shall not be allowed without the prior written consent of the Lessor. A fine of $500 per pet will be charged if rules are broken.

Parking. Only utilize the driveway and/or garage when parking your vehicle(s) NO STREET PARKING permitted at any point of the day. There is a city limitation of vehicles per stay for this property please see listing for details. Any parking that may be provided is strictly self-park and is at Lessee's risk. Lessor is not responsible for, nor does Lessor assume any liability for damages caused by fire, theft, casualty or any other cause whatsoever with respect to any car or its contents.

Ordinances and Statutes. Lessee shall comply with all statutes, ordinances and requirements of all municipal, state and federal authorities now in force, or which may hereafter be in force, pertaining to the use of the premises.

Repairs or Alterations. Lessee shall be responsible for damages caused by his negligence and that of his family or invitees and guests. Lessee shall not paint, paper or otherwise redecorate or make alterations to the premises.

Outdoor furniture: Winds can kick up at a moment's notice. If an accident does happen and is not reported to us, the guest will be held responsible for the cost of replacing any outdoor items.

Lessee Assumes legal Responsibility for compliance of all occupants of the vacation rental or their guests with all provisions set forth in this rental agreement.

Upkeep of Premises. Lessee shall keep and maintain the premises in a clean and sanitary condition at all times, and upon the termination of the tenancy shall surrender the premises to Lessor in as good condition as when received, ordinary wear and damage by the elements excepted.

Assignment and Subletting. Lessee shall not assign this Agreement or sublet any portion of the premises without prior written consent of the Lessor.

No Smoking: No smoking anywhere on the premises... $150.00 fine may be imposed if cigarette butts are found on the property. Any illegal drug use and/or illegal substances are strictly prohibited. This will cause immediate cancellation of your stay with no refund.

Backyard: Guest responsibility to wipe down BBQ and turn off gas line to both firepit and BBQ. If used during your stay, the cleaning crew charges an extra $50 if the BBQ is excessively dirty. Never leave children unsupervised at our property without any adults present. Guests are fully responsible for the safety and security of their children at all times, as well as any disturbance caused to other residents in the neighborhood. Do not keep the fire pit on for longer than 4hrs at a time. Please avoid using glassware outside. City requires all outside lights to be turned off by 11PM.

Hot Tubs:Some of our homes have spa/hot tubs. We make every attempt to ensure that the hot tubs are in service and ready for your arrival. However, there are times when a hot tub is out of service due to circumstances beyond our control. We do not charge extra for any of our hot tub amenities, and there will be no refund if a hot tub is not in service when you arrive. We always try our best to give proper warning if for whatever reason the unit is unusable. Hot tubs are strictly for use by guests over the age of 18 and at the user's own risk. Must not be used by guests with medical conditions that prohibit their use, or by guests who have been consuming alcohol or other cognitive-altering substances. Irresponsible use of the hot tub (leaving a hot tub uncovered, leaving jets running while not in use, spilling liquids in the hot tub, broken glass, etc) can result in a fine of $150 extra cleaning/service fee.

Right of Entry. Lessor reserves the right to enter the premises at all reasonable hours for the purpose of inspection, and whenever necessary to make repairs and alterations to the premises.

Attorney’s Fees. This agreement will be governed in accordance with the laws of the State of California. The prevailing party in an action brought for the recovery of rent or other moneys due or to become due under this lease or by reason of a breach of any covenant herein contained or for the recovery of the possession of said premises, or to compel the performance of anything agreed to be done herein, or to recover for damages to said property, or to enjoin any act contrary to the provision hereof, shall be awarded all of the costs in connection therewith, including, but not by way of limitation, reasonable attorney’s fees.

Rules and Regulations. Lessor’s existing rules and regulations, if any, shall be signed by Lessee, attached to this agreement and incorporated into it.

Trash and Refuse Disposal. Trash and refuse shall not be stored within public view, all trash bags must be in proper trash containers on scheduled trash collection day.

Release of Liability. Lessee hereby waives and releases any claims against Lessor, the Property Owner and their successors, assigns, employees or representatives, officially or otherwise, for any illness, disease, injuries or death that may be sustained by Lessee, or anyone in Lessee's party, on or near or adjacent to the Property, including any common facilities, activities or amenities. Lessee agrees to use any such facilities or amenities entirely at the Lessee's own initiative, risk and responsibility.

Force Majeure: No refunds will be provided due to inoperable appliances, pools, hot tubs, elevators, wifi, etc. if applicable. The Owner will make every reasonable effort to assure that such appliances will be and remain in good working order. No refunds will be given due to power blackouts, water shortage, flooding, weather, pests, wildlife, construction at adjacent properties, or mandatory evacuations of the area by county officials due to hurricanes or other potentially dangerous situations arising from acts of god or nature.
