1. CHECK IN AND OUT Check-in is at 3PM and checkout is at 10 AM

2. OCCUPANCY LIMIT The HOA has instituted an occupancy limit for all the condos which we also honor. 1 bedroom= 4 persons, 2 bedrooms = 6 persons, 3 bedroom = 8 persons and 4 bedroom = 10 . This is to limit noise levels and wear and tear on the property. The condos are not meant to house more than this limit. If found in violation of occupancy the fine issued is $100/day.

3. FRONT AND GARAGE GATE ACCESS The front and garage gates shall be kept closed and locked at all times so that owners and guests can maintain as much security as possible. Both gates are controlled by your controller. When entering or exiting the garage, please make sure that the garage door closes properly before leaving the area. This helps to prevent unauthorized people or vehicles from entering the property.

4. PARKING

• All vehicles on the premises must have a valid license and current registration.
• Any vehicle that cannot be driven, for any reason, must be removed from the property at the Owner’s expense.
• No oversized vehicles that extend beyond the red painted fire lanes are allowed in parking stalls.
• Vehicle parking is subject to all state, municipal and local laws, ordinances or regulations.
• All vehicular or motorcycle parking shall be permitted within numbered stalls only. Parked motorcycles between wheel stops and any building or wall will not be permitted. Any violations will be towed at the Owner’s expense.
• Mechanical maintenance of any kind on a vehicle is prohibited within the property.
• It shall be the responsibility of each space assignee to keep his/her space free of trash or debris, including oil stains on the pavement. No trailers or storage of any personal items is allowed in parking space areas.
• Vehicles shall not block access to the assigned space of any other unit or hinder traffic in or out of the parking lots.
• Vehicles parked in a space assigned to another unit shall be subject to immediate towing at the vehicle Owner’s expense. Owners may authorize a vehicle to be towed from their marked parking space.
• Car alarms should not be set too sensitive so as to go off constantly.
• All vehicles parked in visitor parking spaces must display either an owner sticker or hang tag or a valid rental hang tag or parking permit. - Vehicles without a proper parking sticker, hang tag, or permit may be towed without warning.
• Vehicles parked in front of dumpsters, or otherwise preventing trash service access to the dumpsters, may be towed without warning.
• Vehicles parked in violation of any posted sign or adopted rule may be subject to towing without further notice at the vehicle Owner’s expense.

5. NO SMOKING! There is no smoking allowed in any of our condos whether on the balcony or inside. Violation is subject to a $500 charge on your security. Likewise, Marina Del Mar also prohibits smoking in common areas.

6. BALCONY AND COMMON AREA RULES

• All Common Areas are to be used in such a manner as to not disturb others. No Owner, Resident, Visitor, or Guest may create noise which unreasonably affects any other Owner, Resident or Guest. Noise and disturbance that can be heard more than 2 units away is not acceptable.

Quiet hours are 10pm to 8am.

• Personal items shall be maintained only within the exclusive use portions of the Common Area.
• There is to be no storage of items including, but not limited to, beach chairs, surfboards, boogie boards, coolers, etc. in Common Area hallways or walkways.
• All doors and gates must be closed and locked at all times when not in use. Leaving a gate tied or propped open is prohibited.
• No items are to be hung or attached to the Common Areas of the condominium.
• Bicycle riding, skate boarding and skating are not permitted within the Common Area except for ingress and egress.
• No climbing, scaling, or jumping from or over any railings, balconies, walls etc. is allowed.
• Outdoor cooking is limited to the BBQs provided in the pool area. Cooking on balconies, patios, in hallways or near the buildings is strictly prohibited.

7. GARBAGE Garbage, recycling and compost located in front of office at northwest corner. No trash should be stored in hallways outside of individual units. Dumpsters are provided for the disposal of normal household waste. Use of the dumpsters for the disposal of hazardous or toxic materials including, but not limited to paint, electronics, flammable liquids, auto parts, appliances and tires is strictly prohibited. Nothing shall be left outside in the area outside of the dumpsters including but not limited to furniture, construction debris, etc. If items cannot fit within the dumpsters, the Owner is responsible to arrange for removing the items from the property. Blue recycling bins are provided for recyclable cans, bottles, and paper.

8. NO PETS Absolutely no pets are allowed inside the unit. If evidence of pets is found a $500 fine will be charged.

9. POOL & SPA

• Pool hours are from 9:00 a.m. to 10:00 p.m.
• All sand must be removed at the shower before entering the pool area.
• No glass is allowed anywhere in the pool area.
• No diving into the pool or spa; no running around the pool area; no pushing into the pool or spa.
• Do not throw pool furniture, rocks, stones, coins or anything else into the pool or spa.
• No person under the age of fourteen (14) are allowed in the pool area unsupervised. All incontinent persons shall wear protective swim diapers in the pool or spa at all times.
• No boogie boards, surfboards, wetsuits, recreational floating devices, etc. are allowed in the pool area.

Animals are not allowed in the pool area (California Code of Regulations, Title 22, § 65534) except for guide dogs, signal dogs, and service dogs bearing an identification tag issued by the County Clerk or other government agency, and all such service dogs shall remain on a leash at all times (California Civil Code § 54.1).
