--- ROCKY HAVEN COTTAGE SHORT TERM RENTAL AGREEMENT & GUIDE ---
--- 1.0 Use ---
Rental includes exclusive use of the specified Rocky Haven Cottage for the rental period for recreational purposes only. No commercial, illegal, or other activity shall be carried on at the property. The Renters may not sublet or assign this rental agreement. Renters shall abide with all local by-laws and ensure that adjacent property owners or renters shall have the quiet enjoyment of their properties.
--- 2.0 Occupancy ---
The maximum number of occupants using the cottage premises shall not exceed the total number of 8.
--- 3.0 Pets (very strict – no exceptions) ---
No pets belonging to our guests or their visitors are allowed on the property. Family members have severe allergies that pose health risks. If you show up with animals, you will need to find a kennel off property to care for them or you relinquish your right to rent from us and will not be entitled to any refunds due to lost bookings.
--- 4.0 Smoking ---
No smoking is allowed in the cottage. If smoking outside, renters are to place all butts in ash can ONLY next to fire pits. No butts to be thrown in yard.
--- 5.0 Parking ---
Parking for a maximum of two cars is available. The Renters are to park their vehicle(s) where sign indicates. For oversized vehicles there is parking available at the top of the driveway but please see us for this so we can make sure it is out of the way for others.
--- 6.0 Equipment Provided ---
The cottage comes equipped with: fridge, stove, microwave, dishwasher, washer, dryer, TV, internet, DVD player, coffee maker, toaster, dishes, glasses, cutlery, pots/pans, and general kitchenware, picnic table, lawn chairs, a propane grill, metal fire pit with cover, vacuum cleaner and cleaning equipment. Two kayaks and a canoe with life vests and paddles as well as two fishing poles with basic supplies for each cottage. Life vests are shared between cottages and are located in the brown bin by the boat rack. A liability waiver must be signed before using boats and equipment.
--- 7.0 Internet/Sling TV ---
The cottage is equipped with wireless internet and Sling TV service through the Roku device. There is no phone at the cottage. Renters are advised to bring their own cell phones. Network: Password: Upon Arrival.
--- 8.0 Plumbing ---
The whole 3Havens property is served by a single private well and septic system. Renters agree to abide by the following rules to ensure the proper functioning of the systems:
No taps left running while performing grooming tasks or dishwashing . No paper waste to be placed in the toilets except toilet paper. No food scraps to be washed down the sink - animal fats to be left to harden and placed in garbage.
--- 9.0 Furnace and Air Operation and Electricity ---
The cottage is heated by radiant heat downstairs and the thermostat is in the hallway. *Please note, radiant heat throughout the cement slab takes a while to heat up the space. The warm floor feels so nice on the feet. By the same token, it takes a while to cool when you turn the thermostat down.
The upstairs bedroom has a heat pump operated by the remote control on the dresser. The heat pump has an air conditioning feature for upstairs cooling and an air conditioner window unit is provided for downstairs cooling. Ceiling fans do a great job in cooling down the common space most of the year. There are fans in each bedroom if needed.
Renters are asked to act responsibly in conserving propane for heating:
No doors/windows should be left open during the cooler seasons while the heating is on. For your convenience there is lighting on the waterfront. The light switch is a three way so a switch is located at the outside corner of the cottage near the entrance and there is one on the 5 foot pole on the waterfront.
--- 10.0 Fire pit ---
The cottage is equipped with one wood burning metal outside fire pit in its own designated area. Brass plates on the benches identify each space. Renters agree to abide by the following rules to ensure fire safety:
Renters provide their own firewood (may be purchased along Rt. 1). Sometimes renters leave behind unused wood too. Only untreated firewood is to be burned in the fire pit. Any dry fallen branches on the property may be used too. Fires are not to be left unattended or in the care of children. A metal bucket of water is to be kept on hand when the fire pit is in use. The Fire screen is to be used at all times. Fires are to be extinguished upon retiring for the night. Renters are to abide by all municipal by-laws and bans (if any) regarding outdoor fires and will be responsible for any fines incurred. Call the Orland town office for details. ---
NO FIREWORKS ARE PERMITTED ON THE PROPERTY DUE TO INSURANCE COVERAGE.
--- 11.0 Propane Grill ---
The Renters agree to abide by the following rules for use of the Grill: The Grill is NOT to be moved from its location due to fire safety requirements. The Grill lid must open before lighting. The Grill has a self-lighting mechanism. Only propane gas is to be used for cooking on the Grill: no other materials are to be added. The Grill is not to be left unattended when lit. The gas is to be turned off at the tank after use. The Grill is to be cleaned (non-abrasive on Griddle please) and the grease pan emptied after cooking in order to deter animals (racoons and bears). The plastic cover replaced once it is completely cool.
--- 12.0 Bedding and Linens ---
The cottage is equipped with one King size bed and two Double/twin size bunkbeds. Each bed is supplied with its own mattress cover, pillows, sheets, and coverlet. Additional blankets can be found in the closets.
--- 13.0 Liability and Risk ---
The owners have endeavored to ensure all information respecting the cottage is current and accurate and the cottage is suitable for recreational use. The owners do not warrant or guarantee the quality of the cottage as this is basically a subjective opinion. The renters acknowledge that the use of the property is entirely at the renter’s own risk. The renters shall indemnify and hold harmless the owners against and from any and all expenses, costs, damages, suits, actions or liabilities arising from any and all loss of or damage to personal property, injury, personal condition or death resulting from the use of the rental property, grounds, and lake/pond use.
Renters swim and use the kayaks, canoes or boats at own risk. The owner’s property insurance covers the dwelling and the owner’s contents. It is the renter’s responsibility to insure against any unforeseen damage or loss of the renter’s own possessions. The renters shall give the owners prompt written notice of any accident, unsafe or dangerous condition, other defect to the cottage, surrounding property, buildings, equipment, or other possessions belonging to the owners.
--- 14.0 Safety and Damage Prevention (Important) ---
The renters are responsible for all damages caused by any member of their party, or their visitors or guests, even to the extent that these damages may exceed the Security Deposit provided. The renters shall be liable for any damage done by reason of water being left running from taps in the cottage or improper use of appliances, equipment provided, or fire pit.
--- 15.0 Smoke Alarms/CO Detectors ---
These items are installed as required by the fire code.
Renters are not to disable or remove batteries from the smoke alarms or carbon monoxide detectors
--- 16.0 Power Failure Procedures ---
In the event of a power failure, the rental units are equipped with automatic backup generators for your convenience.
--- 17.0 Owners Access ---
The Renter shall be allowed an access code to the cottage during the renter’s occupancy only
--- 18.0 Severability ---
If any provisions of this agreement are invalid, such provisions shall be considered separable and the remaining provisions shall remain in full force and effect.
--- 19. Arrival Procedures ---
Renters may arrive after 3:00pm on the possession date agreed to in the Rental Agreement. Upon arriving at the cottage, Renters are to familiarize themselves with the cottage and its amenities. If anything is missing, damaged or not working, or if the cottage has not been left in an appropriate state of cleanliness, they are to contact the Owners immediately.
--- 20. Departure Procedures ---
Renters are to leave no later than 10:00 on the date agreed to in the Rental Agreement.
Renters agree to keep the cottage and all furniture, fixtures, fittings, and effects in/or about the cottage in the same state of repair and condition in which they found them upon arrival. Refer to the following DEPARTURE CHECKLIST (posted in cottage too). Compliance with that list insures complete return of the security deposit.
--- 21. Departure Checklist ---
In order to receive a full security deposit refund, renters shall complete all the tasks spelled out on the Departure Checklist before leaving the cottage:
All dishes, glasses, cutlery, pots and utensils thoroughly cleaned and returned to kitchen cabinets/drawers.
Fridge, freezer and cupboards to be emptied of all foodstuffs. All used bedding and sheets placed in pillow cases and left in the bedroom, dirty towels in mesh bag left in bathroom.
The grill cleaned and grease pan emptied. Gas turned off and cover replaced on cool BBQ. Kayaks and Canoe locked. Keys for kayaks returned to the window sill above the kitchen sink.
All garbage placed in a LARGE plastic garbage bag and placed in dumpster at top of driveway.
--- 22. Security Deposit ---
This security deposit will be returned within 14 days following the end of the rental period. If any charges or damages have been incurred (including pay per view, lost keys) these costs will be deducted from the Security Deposit.
--- 23. Dock System Safety ---
There is a dock available for use by Rocky, Toddy and Cozy Haven guests. If you choose to swim or jump off the dock, you do so at your own risk. There are many rocks beneath the surface of the water and bodily injury may occur. Boats can use the dock for loading and unloading passengers and supplies. However, the dock is not sturdy enough for boats to be tied up for prolonged periods of time (especially in windy or wavy conditions). In such cases, you may either anchor the boat or use the mooring provided if it is available.
--- 24. Security System ---
For safety, there are video cameras guarding the exterior of the buildings and canoes. There are no cameras inside any of our cottages.
--- 25. Acceptance ---
By booking online through any of our online partners, renters agree to everything in this rental agreement.
