General
Terms & Conditions applicable to all
Tour/Cruise/Vacation Bookings
made through Stayfinder.com between you and the listed
service provider.
Once
listed service provider accepts your booking by
confirmation, a contract is bound between you and the
listed company. The terms and conditions are detailed
below.
The
listed service provider's Responsibilities
Your Reservation
Upon your booking through Stayfinder.com for a
particular service, subject to availability, the
listed service provider will reserve your place on
your selected itinerary and the confirmation will be
sent to you through Stayfinder.com or in some cases
directly. A contract is only bound between you and
listed service provider when your booking has been
confirmed and accepted by the service provider and its
communication thereof to you.
Price Guarantee
The list of prices are based on costs and exchange
rates for the validity period of the listings. Should
these costs change, it may be necessary to make a
surcharge on the price of your vacation. Should the
total tour price increase by more than 10 percent, you
will have the right to cancel within seven days of
notification without penalty. The guarantee does not
apply to any taxes, charges, or levies imposed by any
government or their agencies. In exchange for these
guarantees, no refund will be made if costs are
reduced.
Change and/or Cancellation
The service provider reserves the right to change or
cancel your booking in accordance with its operating
requirements or circumstances beyond its control.
Should change or cancellation prove necessary, the
service provider will give you reasonable notice
thereof, in the circumstances, and where available,
offer you a comparable alternative.
If an alternative is not available or acceptable, you
will be entitled to either a full refund of money paid
by you to the service provider or a transfer to
another service provider's service without payment of
any transfer fee. If the change or cancellation is due
to conditions beyond the service provider's control
(i.e. circumstances like political unrest, war, or
threat of war, riots, civil strife, closure of
airports or ports, industrial disputes, terrorist
activity, nuclear disasters, fire, epidemic or health
risk, acts of God, natural calamities, adverse weather
conditions etc.) the service provider will give a full
refund of money paid to the service provider less
reasonable expenses incurred by the service provider
in respect of your booking.
Details and Conditions
The information in the service provider's listing is
correct to the best of its knowledge, but it cannot
guarantee that any item or amenity mentioned will be
available especially where the service provider has no
direct control over it. The service provider will do
its best, at its discretion, to select accommodations,
sightseeing tours and transportation to give you good
value for your money. The service provider constantly
strives to improve tour itineraries and features. If
such improvements can be made, or unforeseen
circumstances beyond its control make changes
necessary, the service provider reserves the right to
vary itineraries and to substitute hotels. The service
provider is not responsible for any other travel
arrangements affected due to its cancellations.
Liability
The service provider is responsible to you for
properly arranging and conducting your itinerary.
Stayfinder.com, on the receipt of any amount of money,
hold that money for you until the booking is confirmed
and will be transferred to the service provider as per
the agreement made and revised from time to time
between the two parties. Stayfinder.com and the
service provider will be entitled to keep for each
account any interest earned on such amount. The
payment of a deposit or any other money in respect of
your booking shall be deemed to be an authorization to
disburse thereof as aforesaid.
The service provider makes arrangements with carriers,
hoteliers, and other independent suppliers to provide
you with some or all the travel services you purchase.
These parties are independent suppliers over whom the
service provider has no direct control. The service
provider is responsible to you for properly arranging
and conducting your itinerary only. Unless caused by
its own negligence, the service provider is not
responsible for and accepts no liability in respect of
any claims, losses, damages, costs, or expenses
arising out of:

Personal
injury, sickness, disease, accident, or death,
however caused, including without limitation,
where same results from your conduct on
vacation;
-
Loss
or damage or delay of baggage or other property
unless resulting from the service provider's
negligence in which case the service provider's
liability shall be limited to the actual loss, but
in no event would exceed the total vacation cost;
-
Delays
and loss due to government action, weather,
mechanical breakdown, equipment failure, labor
disputes, sickness, acts of war, insurrection,
terrorism, acts of God, or any other causes beyond
the service provider's direct control;
-
Acts
or omissions, whether negligent or otherwise, of
suppliers of services or their personnel
(including, without limitation, transportation and
accommodation services) or of any other person or
body unless such a person or body is employed by
the service provider, or is an agent of the
service provider, and is acting within the scope
of his or her authority. In no event is the
service provider liable for the acts or omissions
of independent, third party contractors or of its
own employees or agents acting outside the scope
of their duties;

Loss
of enjoyment, upset, disappointment, distress or
frustration, whether physical or mental, resulting
from any of the following:

Any
matter or topic described in sub-paragraphs
(a) to (d).

Your
failure to obtain the necessary
documentation to travel.

Your
failure to arrive on time for initial
departure or for connections
within the tour or to stay within or join
your tour at any time after initial
departure.
-
Your
leaving the tour prior to its completion.
-
The
need for the service provider to change
itineraries or substitute accommodation or
services, provided that the service provider
makes every effort to supply the most
comparable services and accommodations
available;

Cancellation
of the vacation by the service provider
provided that a full refund of all the money
paid is made to you.

Sports,
adventure and similar activities inherently
involve risks of injury greater than those
that would be encountered if you were not
participating in such, and therefore, by
voluntarily taking part in any sports,
adventure or other such activities, you
thereby acknowledge and assume any of the
risks inherent therein. In the absence of
negligence on the service provider's part,
or on the part of the service provider's
agents and representatives, neither the
service provider, nor they, accept any
responsibility for, and shall not be liable
for, any injury, illness, damage, loss,
accident, expense, delay or any other
irregularity resulting from your
participation in any of the activities made
available to you.

The
service provider takes every reasonable
precaution possible to assure your comfort,
safety, and enjoyment while you are taking
part in the service provider's itinerary. A
change of climate, food, time and varied
cultural habits often affects travelers
differently. The service provider therefore
recommends that you advise your doctor that
you are taking one of their itineraries and
ask if he or she recommends anything for
your trip, even for something as seemingly
benign as an upset stomach. Since the brands
of any medication to which you are
accustomed may be unavailable in places to
which you are traveling, the service
provider recommends you bring your own
supply of medication carried in the original
labeled bottles. Should you fall ill during
your the service provider's itinerary, the
service provider will make every reasonable
effort to make prompt, sanitary, safe, and
proper medical care available to you.
However, if at anytime or anywhere
treatments of any sort are suggested to you
that do not meet your needs or expectations,
you should not hesitate to contact your own
doctor. Also, please note that the same
sorts of activities that can expose you to
certain types of diseases at home can just
as easily expose you to those same diseases
abroad. This information is provided only
for your convenience and the service
provider is not responsible or liable for
any damages resulting from your failure to
confirm or ascertain health information or
medical precaution, if any, for the places
which you will be visiting.

The
service provider is responsible for taking
care to arrange and conduct your itinerary
properly. With you in mind, it has accepted
applications and interviewed numerous
potential employees, and then it selected
only those people whom it believed in its
best judgment would be responsible and
congenial, tour managers, representatives,
and drivers. Although the service provider
firmly believes, based on personal
interviews and certain disclosures made to
it by its employees, that all of its
employees enjoy excellent health, the
service provider, like other tour operators,
is legally unable to confirm this in most,
if not all, instances.

Your
Responsibilities
Booking Your Itinerary
In order to book your service, you will have to pay a
deposit equivalent to half the total price, per
service to the service provider through
Stayfinder.com's online payment facility. The deposit
is accepted as a first installment of the itinerary
price only once the service provider has confirmed the
booking. Once the service provider has confirmed your
booking, the deposit paid in respect is credited as a
transaction.
Paying the Balance
The balance of the price must be paid on completion of
the service directly to the service provider Or their
authorized agent.
Cancellation
You can make cancellation request to the bookings you
make through Your Account feature at Stayfinder.com
& upon cancellation, you will be liable to pay a
fee to cover the estimate of cost and expenses
incurred by the service provider in the terms of the
schedule set out hereunder. This is expressed as a
percentage of the vacation price and is calculated as
follows:

If
you fail to join a tour or join it after its departure
or leave it prior to its completion, no vacation price
refund can be made. Please note that if the reason for
cancellation falls within the terms of any vacation
insurance policy which you hold, then any such charges
may, subject to the terms of your insurance policy, be
refunded to you by the insurance company.
Changes
If after your booking has been confirmed, you wish to
change to an alternative departure date you may do so
subject to availability and provided the new date is
acceptable & convenient to the service provider.
If you are changing your booking within 45 days prior
to date of travel, normal cancellation fees (as
detailed above) shall apply unless the transfer is to
an earlier departure, in which case only the transfer
fee will be charged.
Services Details and Conditions
Please read the listings carefully for those items
included in the price. No allowance or refund can be
made for meals, accommodations, excursions, etc. that
you elect not to take.
The service provider must be advised of any medical
conditions, or physical disability requiring special
attention when you make your booking. You are
responsible for all travel arrangements and costs
to/from the point of commencement/conclusion of the
holiday.
There may be times when the service provider manager
or representative has to make a decision in the
interest of your safety and well being. You agree to
comply with the authority and decisions of the
appointed service provider's tour manager or
representative and the laws of the country in which
you are traveling. If you do not so comply or if, in
the service provider's Tour manager's or
representative's opinion, you are not compatible with
the general enjoyment and well being of other members
on the holiday or smooth operation of the holiday
itself, the service provider reserves the right to
refuse to let you continue with the holiday. In such
event, you will be responsible for your own
repatriation and related costs and have no claims
against the service provider.
It is your responsibility to have a valid passport and
all visas, permits, and certificates required for your
selected holiday as well as any necessary vaccinations
and to comply with all applicable laws.
Wild Animals
Please be aware that wildlife tours may take you into
close contact with wild animals. Attacks by wild
animals are rare, but no tour into the wilderness can
guarantee that this will not occur. Neither the
company, nor their employees, nor agents can be held
responsible for any injury or incident on the tour.
Health
It is your responsibility to ensure that all
precautions are taken and medical advice has been
sought prior to your tour departure. Malaria is a fact
of life in certain areas of Asia. It is essential that
upon consulting a doctor or advisor that you mention
all places you will be visiting. For some countries a
valid certificate of vaccination against certain
diseases may be required. Please ensure that you
consult your doctor for advice. More information can
be obtained from embassies and advisors of infectious
diseases.
Insurance
Please note that there are no travel insurance
provided as part of the service you book and unless
you have entered into a separate agreement with a
travel insurance provider prior to your travel you
won't be eligible for insurance cover of any nature.
Illness or Absenteeism
In the event of your withdrawal from a holiday after
the commencement as a result of illness, you must
obtain a medical certificate in support of any
insurance claim. Unfortunately, no refunds can be made
for absences from a tour, including, but not limited
to, missed meals or sightseeing.
What's Not Included in the Tour Price
Airfares to and from your vacation destination,
airport taxes, passport and visa fees, insurance,
laundry, phone calls, beverages, meals not detailed in
the itinerary, tips to tour managers, drivers and
local guides, items of a personal nature, excess
baggage, optional excursions.
Weather Conditions
Under no circumstances can the service provider be
held responsible for the weather conditions, nor can
any holiday be cancelled or amended by you at any time
on the basis of snow or weather conditions.

Miscellaneous
Contracting Parties
The booking conditions detailed herein contain the
entire contract between you and the service provider.
No representation, term, warranty or condition can be
expressed or implied by reference to any other
writing, advertisement or conversation.
Your contract is with the service provider as the
travel service company. At any time and at the service
provider's complete discretion, it may nominate to you
in writing any other company or person to have the
benefit of some or all of those provisions of this
contract, which the service provider may then specify,
as if you had agreed to the provisions concerned
directly with that company or person in the first
place, as well as agreeing to them with the service
provider. The service provider may, at its complete
discretion, assign all or any rights and liabilities
arising under or by virtue of this or any other
contract with you.
All bookings with carriers, hoteliers, and other
service providers are subject to the terms and
conditions and limitations of liability imposed by
those carriers, hoteliers, and other service
providers. Please note that some of these limit or
exclude liability in respect of death, personal
injury, delay and loss or damage to baggage. While the
service provider cannot accept any responsibility for
any loss as a result of such actions or as a result of
any act or omission of any such third-party, it will
give every reasonable assistance in helping to resolve
any reasonable dispute.
